Condos offer conveniences that townhomes and single family properties don’t. The commercial of sale, in addition to such other matters because the unit owners’ affiliation finds applicable, shall set forth a description of the property to be bought, which description need not be as in depth as that contained within the deed of belief, but shall identify the property by avenue deal with, if any, or, if none, shall give the final location of the property with regards to streets, routes, or identified landmarks.
D. The quantity of all frequent expenses not specially assessed pursuant to subsection A, B, or C hereof shall be assessed in opposition to the condominium units in proportion to the number of votes in the unit house owners’ affiliation appertaining to each such unit, or, if such votes had been allotted as provided in subsection B of § 55-79.seventy seven , those common expense assessments shall be either in proportion to these votes or in proportion to the models’ respective undivided pursuits within the common parts, whichever basis the condominium instruments specify.
The courtroom shall enter a decree reflecting the reallocation of undivided pursuits produced thereby, and the award shall embrace, without limitation, just compensation to the unit owner of such unit for his entire undivided curiosity in the common parts and for his entire unit.
Supplied, that after the recording of the declaration, no lessor who executed the identical, and no successor in interest to such lessor, shall have any right or power to terminate any part of the leasehold curiosity of any unit proprietor who makes timely payment of his share of the hire to the individual or persons designated in the declaration for the receipt of such rent and who in any other case complies with all covenants which, if violated, would entitle the lessor to terminate the lease.
H. Following termination of the condominium, the proceeds of any sale of property, along with the property of the unit homeowners’ affiliation, shall be held by the unit homeowners’ affiliation as trustee for unit house owners or lien holders on the items as their pursuits might seem.
